Who can reclaim care home fees?

Fees can only be reclaimed for care provided after 1 April 2012 unless there are exceptional circumstances.

Everyone currently in care who is either paying the full amount or a contribution to their care may be eligible to make a claim, as are the estates of people who were paying towards their care but have passed away since April 2012.

Who is eligible for NHS care home funding?

In a nutshell, the NHS should fund full nursing care for patients with a primary need, regardless of their financial situation. Anyone who needs long-term nursing care, whether in a residential home or not, should have an assessment by the NHS to determine whether they are eligible for continuous healthcare funding.

If you, or a relative, did not have an assessment – or if you disagreed with your assessment outcome – then you do have a right to challenge it.

If nursing needs are incidental to the need for accommodation, then funding is not normally provided by the NHS. It’s a difficult distinction to make, so please contact the team to discuss your individual circumstances.
